The National Security Service of the Republic of Armenia, as a result of operative-search activities undertaken, within the implementation of the functions vested upon it by the law, to counteract corruption, detected another cases of receiving a bribe in big amounts by officials from a representative of an economic entity to conduct actions, within their power, in favor of the latter, of abusing power, of making and using official false documents by servants of local government body and commercial organization.
According to established factual data, the employee coordinating the transactions of immovable property of the Abovyan community municipality of the Kotayq marz of the Republic of Armenia, in order to alienate, with right of preference by direct sale, at the cadaster price, to the economic entity the plot of land with an area of 7175.83 square meters adjacent to the hotel, formerly built without permission, functioning on Hatis Street of the town of Abovyan, included, in the package of documents on the transaction, false data that did not correspond to reality, and the servant of a commercial organization making measurements drew false official documents.
Using these documents a number of officials of the community municipality of Abovyan abused their official powers for group interest, didn’t perform official duties while acting against the service interest, didn’t follow the requirements of the RA Government Decision N 912-Ն of 18 May 2006 on “ Establishing the Procedure for the Legalization and Disposal of Unauthorized Constructions” and, as a result of this the mentioned plot of land was alienated by the decision of the Council of the Elders of Abovyan community made on 30 April 2019, which had heavy consequences: it caused material damage-around 39.000.000 AMD- to the budget of the community.
Besides, it was found that the officials of the community municipality of Abovyan in order to legalize, by renting out, the construction, which was earlier constructed on Saralanj street, city of Abovyan, without authorization and used by the same economic entity as a funeral service, demanded a bribe from the entrepreneur, via the above-mentioned employee coordinating the mentioned sphere, and on 28 February 2019 in their office received 1500 USD (719.355AMD) under the control of operational units of the NSS of RA, afterwards on 8 May 2019 respective decision was made by the Council of the Elders of the community.
On June 6 2019, a criminal case on the alleged crime has been instituted in the Investigation Department of the NSS of RA under the 3rd part 3rd clause of Article 311, 2nd part of Article 312, 2nd part of Article 308, 1st part of Article 325 and 2nd part of Article 214 of the Criminal Code of RA.
The preliminary investigation of the case is ongoing; measures are being taken to reveal all the corruption-related crimes in the said area, as well as to identify persons related to them and to give penal assessment to their actions.

Note: A person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the Criminal Procedure Code of RA and unless the verdict comes into legal force.
